Is Divorce Mediation Suitable for You?

The suitability of your case for Divorce mediation may be easier than you think to work out! You may well understand the benefits of this process, but unless you fit cetain criteria, you will be unlikely to find it effective.

Unsuitable Cases

  • If either you or your partner are unwilling to negotiate, then this is a process that you are probably not going to be very successful in
  • If either or you suffers from any major mental or physical disabilities then it would be inappropriate to use Mediation as you require full Legal advice and representation
  • When there are Crimimal or Child Protection issues involved, then your divorce must go through the Courts
  • If there is extreme conflict between you and one or other of you is unable to stand up themselves against the other then Mediation is not an option for you both
  • If one of you has no confidence that the other will uphold any agreements reached through talkingn & discussion then your time will be wasted trying to find a resolution this way as it will not be enforced at a later date
  • If Mediation Breaks Down

    Your Mediator should assess your suitability for the process ongoing and will refer you directly back to your Attorneys / Solicitors should no agreement or resolution be reached.

    In the instance that this whole process actually breaks down for you during your sessions, Court representation will most likely be your only option.
